1. About FakedexBuilder
FakedexBuilder ("the Platform", "we", "us", "our") is a web-based creative tool that allows users to design, organise, and catalogue original creations of any kind using a structured, encyclopaedia-style format. Users can build custom entry databases, create fictional regions and worlds, assign attributes to their creations, and share their work with the community. While the Platform was built with fan-creation communities in mind, it is a general-purpose collection-building tool and is not limited to any particular fandom, genre, or style of content.
The Platform is operated by an individual based in the United Kingdom.
These Terms and Conditions ("Terms") form a legally binding agreement between you and the Platform. By accessing or using FakedexBuilder, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
2. Intellectual Property and Fan Creativity
FakedexBuilder is an independent creative tool. The Platform acknowledges the following clearly:
- FakedexBuilder has no affiliation with, endorsement from, or licensing arrangement with Nintendo, Game Freak, Creatures Inc., The Pokémon Company, or any other third-party rights holder. Where rights holders are named in these Terms, they are named solely to make this lack of affiliation clear.
- The Platform incorporates certain game reference data (such as type names, move names, and ability names) sourced via a publicly available third-party API (PokeAPI) as a creative framework for users' original designs.
- The Platform does not reproduce, host, or distribute any third-party-owned artwork, sprites, game code, or trademarked characters.
- All visual content on the Platform is original work created and uploaded by users.
The Platform is intended for original creative content. Users are responsible for ensuring that any content they upload does not infringe the intellectual property rights of any third party. The Platform's acceptance of fan-inspired content created using original artwork is consistent with established fan-community practice and does not constitute any warranty that such content is free from third-party IP risk.
3. Eligibility and Account Registration
You must be at least 13 years old to create an account or use the Platform. We do not knowingly permit users under the age of 13 to hold an account. If we become aware that an account is held by a user under the age of 13, we will suspend the account and delete the associated personal data in accordance with our Privacy Policy.
If you are aged 13 to 17, you may only use the Platform with the permission of a parent or guardian, and your parent or guardian must agree to these Terms on your behalf. Parents and guardians remain responsible for a minor's use of the Platform, including any purchases made.
By creating an account, you confirm that:
- you are at least 13 years old;
- the information you provide is accurate and complete; and
- you are eligible to enter into a legally binding agreement (or, if you are under 18, your parent or guardian has agreed to these Terms on your behalf).
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly if you suspect any unauthorised use of your account.
4. Acceptable Use and Community Guidelines
Your use of the Platform is governed by our Community Guidelines, which form part of these Terms and are incorporated by reference.
In summary, you agree not to upload, share, or create content that:
- is sexually explicit or suggestive in any way, regardless of the age of the characters depicted;
- sexualises, targets, or endangers minors;
- contains graphic violence, gore, or real-world harm;
- constitutes hate speech, harassment, or content that dehumanises individuals or groups based on their characteristics;
- reproduces third-party-owned artwork, sprites, game assets, trademarked characters, or branded material without authorisation, regardless of the rights holder — including assets owned by games publishers, film studios, television networks, and real-world brands;
- contains real-world personal information about other users;
- is illegal, defamatory, or otherwise harmful under applicable law.
The Platform's content standard is all-ages and inclusive, comparable to content suitable for a PEGI 7-rated family game. This standard applies equally to all users and all content.
If you become aware of content on the Platform that you believe infringes third-party intellectual property rights, please report it to us at fakedexbuilder@gmail.com. We will investigate and act on valid reports promptly.
We reserve the right to remove content and suspend or terminate accounts where these Terms or the Community Guidelines are violated.
5. User Content and Ownership
You retain full ownership of all original content you create and upload to the Platform, including your designs, artwork, region lore, and written material ("User Content").
By uploading User Content to the Platform, you grant FakedexBuilder a limited, non-exclusive, royalty-free licence to:
- display and present your content on the Platform;
- reproduce your content as necessary to operate and maintain the Platform (for example, in thumbnails, previews, and backups); and
- use your content in promotional materials for the Platform, such as feature showcases or community highlights.
This licence does not transfer ownership of your content to us. We will not sell your content to third parties or use it for any purpose outside of operating, improving, and promoting the Platform without your explicit consent.
6. Platform Ownership
FakedexBuilder — including its code, design, user interface, visual style, structure, features, and overall look and feel — is the intellectual property of the Platform operator. All rights are reserved.
You may not copy, reproduce, reverse-engineer, decompile, or create derivative works based on the Platform or any part of it without our prior written consent.
7. Automated Access and AI Training
We take the protection of user-created artwork and Platform content seriously. The following restrictions apply to all users and any third parties accessing the Platform:
- You may not scrape, harvest, download, reproduce, or otherwise extract content from the Platform — including images, artwork, designs, written material, or structural data — for any purpose, including training artificial intelligence models, building datasets, competitive analysis, or any form of automated processing, whether for commercial or non-commercial use.
- You may not use automated tools, bots, crawlers, or scripts to access, extract, or index any part of the Platform without our prior written consent.
- You may not attempt to circumvent any technical measures the Platform employs to protect against unauthorised access or data extraction.
The only exception to the above is search engine crawlers indexing the Platform's public-facing home page for the purpose of standard web search indexing (SEO). All other automated access is prohibited.
FakedexBuilder will never use User Content for AI training purposes, nor sell User Content to any third party for AI training, without the explicit written consent of the content's creator.
8. Privacy and Data
Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy sets out how we collect, use, store, and protect your personal data, including our use of cookies and similar technologies, and our obligations under UK GDPR and the ICO's Age Appropriate Design Code (Children's Code). Please read the Privacy Policy carefully before using the Platform.
9. Payments, Subscriptions, and Refunds
Note: No paid features are currently live on the Platform. The following terms apply in anticipation of future monetisation and will take effect when paid features are introduced.
9.1 Micropurchases
The Platform may offer micropurchases to expand creation slots and access other features. Each purchase is a one-time transaction for a specific digital benefit.
9.2 Subscriptions
The Platform may offer subscription plans providing access to advanced features. Subscriptions are billed on a recurring basis via Stripe. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
9.3 Digital Goods
The Platform may offer digital goods such as icon packs, trainer art, and region art for purchase.
9.4 Commissions
The Platform may facilitate art commissions between users. Commission terms, pricing, and artist–platform revenue splits will be set out separately at the point of transaction.
9.5 Cancellation and Refunds
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers normally have a 14-day right to cancel purchases of digital content made at a distance.
By completing a purchase of digital content on the Platform, you:
- expressly request and consent to the immediate supply of that digital content within the 14-day cancellation period; and
- acknowledge that you will lose your right to cancel once supply of the digital content has begun.
This waiver is made in accordance with Regulation 37(1) of the 2013 Regulations, and you will be asked to confirm it at the point of purchase.
Nothing in these Terms limits or excludes your statutory rights under the Consumer Rights Act 2015, including your right to a repair, replacement, or refund where digital content is faulty, not as described, or not of satisfactory quality.
Payments are processed by Stripe. By making a purchase, you agree to Stripe's terms of service in addition to these Terms.
10. Competitions
The Platform may host community competitions from time to time. All competition entries must comply with these Terms and the Community Guidelines. Specific rules, entry requirements, prizes, eligibility criteria, and deadlines will be published separately for each competition.
We reserve the right to modify or cancel a competition at any time. In the event of cancellation, any entry fees paid will be refunded.
11. Account Suspension and Termination
We may suspend or permanently terminate your account if we reasonably believe you have violated these Terms or the Community Guidelines. We will ordinarily notify you of the reason, except where doing so would be inappropriate (for example, where the violation involves illegal content or the safety of minors).
If you believe your account has been suspended or terminated in error, you may appeal by contacting us at fakedexbuilder@gmail.com within 30 days of the decision. We will review your appeal and respond within a reasonable time, ordinarily within 14 days.
You may delete your account at any time using the self-serve account deletion feature in your account settings. Upon deletion, your account and associated content will be permanently removed from our servers, subject to any retention required by law.
Following termination, any outstanding payment obligations remain enforceable.
12. Platform Availability and Disclaimers
The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or harmful components. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time.
We are not responsible for the accuracy, completeness, or quality of content posted by users. User Content represents the views of its creator, not the views of FakedexBuilder.
13. Limitation of Liability
To the maximum extent permitted by law, FakedexBuilder and its operator shall not be liable for any indirect, incidental, special, or consequential loss arising from your use of the Platform, including loss of data, loss of revenue, or loss of goodwill.
Subject to the paragraph below, our total aggregate liability to you arising out of or in connection with these Terms or your use of the Platform shall not exceed the greater of: (a) the total amount you have paid to the Platform in the 12 months immediately preceding the event giving rise to the claim; or (b) £100.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.
Where the Platform is used by consumers, nothing in these Terms affects your statutory rights under UK consumer protection law.
14. Changes to These Terms
We may update these Terms from time to time. Where changes are material, we will notify users via the Platform or by email with reasonable notice before the changes take effect. Your continued use of the Platform after the effective date of updated Terms constitutes your acceptance of those changes.
If you do not agree to updated Terms, you should stop using the Platform and may delete your account via your account settings.
15. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you have a complaint about the Platform, please contact us in the first instance at fakedexbuilder@gmail.com. We will endeavour to resolve complaints promptly and informally before any formal proceedings are initiated.
